Terms and Conditions

The hiring contract is to be between the hirer and the property owner

Please take a few moments to read and understand the contractual relationship between you and us the Owners of the property which will allow you that all-important peace of mind, both before you leave home and whilst staying in ROKS, Horizons.

These conditions must be strictly adhered to
 

The Occupier is the person named on the booking form, and he/she is responsible for the obligations and conditions of hire. The Occupier shall not pass the booking to another party and shall be in residence at the property during the whole of the letting period. The Occupier must notify the owners of any changes to the number of people staying at the property in writing before the booking starts.

Payment and Deposits

Bookings made more than 56 days in advance require a deposit of 20% and the balance payable 56 days before occupation. If payment is not received by the due date, then the booking is cancelled and the deposit is forfeited. Bookings made 56 days or less before occupation require payment in full at time of reservation.

Cleaning and Damage

The Occupier must agree to take good care of the property and its contents and on departure leave it in a clean and tidy condition.

Any breakages or damage will be paid for by the person who made the booking. 

The Occupier may not be charged for minor items but is responsible for all breakages and damages and the cost will be payable on demand.

All damage, loss or breakage to the property or contents must be reported to us as soon as possible. We will repair the damage as soon as is practical.
Tenant’s liability is not limited.

We reserve the right to refuse any booking.

Occupation

The accommodation is let for the specified number of tenants only.

The name of each occupant is to be listed on the booking form together with the ages of those under 21 years and there is to be no alteration to this list without the prior consent of ourselves. 

We regret we cannot accept bookings from groups where all are under 21 years.
ROKS Horizons is let on the basis that the accommodation is for holiday use only and that no rights to remain in the accommodation exist for the tenant or any person accompanying him/her on holiday.

Premises must be vacated by 10am on the day of departure and occupied after 4pm to allow adequate time for cleaning the premises.

Non-availability of Property

If for any reason beyond our control, the property is not available on the date booked (owing, for example, to fire damage) or the property becomes unsuitable for holiday letting, you will be given a full refund. The tenant shall have no further claim against us.

Website or Social Media

We reserve the right to amend prices/descriptions quoted in the website / social media due to errors and/or omissions.  Whilst every effort has been made to describe as fully as possible the property in question, we cannot be held responsible for any disappointment caused where a customer has differing expectations to those detailed in the description.   All details on the website are given in good faith and believed to be correct, but their accuracy is not guaranteed.

Car Parking

The use of the car parking space is entirely at the tenant’s own risk.
Only our allocated space may be used. 
We cannot be held responsible should the space not be available for you at any time duting your stay.

Security

Access to the main building is by fob.  Should any fob be misplaced, the full cost of replacing it will be met by the hirer.

Dogs

Dogs are permitted to stay in the property, but are subject to a charge of £25 per dog per week. 
Dogs must not be left unattended in the property at any time, and must be supervised when on the shared balcony.
Dogs are only permitted in the hall and main living areas, and are not allowed in bedrooms.
Your security deposit is at risk if we find that these conditions have been breached.

Smoking

The entire building is strictly non-smoking.
The tenants agree not to smoke nor to allow smoking inside the property, or on its balcony, at any time.

General

Tenants must observe any general rules and regulations applying to the property. Tenants must do nothing to make void any policy of insurance, must not cause a nuisance to neighbours and must allow us reasonable access.

Gas and Electricity

Rental of the property includes, rates, gas and electricity.

Linen and Towels
The property is equipped with bed linen including sheets, duvets, duvet covers and pillow cases.
Tea towels are also provided.
Towels are not provided.

Insurance

We will not be liable for any act, neglect or default on the part of any person nor any accident, damage, loss, injury, expense or inconvenience whether to person or property which the tenant or any other person may suffer or incur arising out of or in any way connected with the letting or resulting from any other cause whatsoever. 

This includes use of the communal splash pool and leisure facilities.
We advise you to arrange your own insurance to cover yourselves and your personal belongings whilst staying at the property.

Circumstances Beyond Our Control

Except where otherwise stated in these Conditions, we the owners shall not be liable for any change or cancellation which is a result of unusual and unforeseeable circumstances beyond our control; for example fire, flood, exceptional weather conditions and epidemics.

Nothing in these Terms and Conditions purports to limit or exclude liability for personal injury or death as a result of the negligence of the owners. Your statutory rights are not affected.

We cannot accept responsibility for work taking place outside the boundary of the property nor for any noise or nuisance arising from works over which we have no control.  We cannot accept liability for events that occur outside our control, such as normal breakdown of domestic appliances; plumbing, wiring and damage resulting from exceptional weather conditions. Once advised of a problem, we will take immediate action to effect a speedy solution, minimising inconvenience caused.

Complaints

We hope your holiday runs smoothly but if you do have a complaint it is essential that you report it immediately so that we can do our best to resolve it. We cannot accept claims for compensation lodged after departure as it is no longer possible to investigate the problem and take remedial action. Under no circumstances will our liability exceed the rental paid for the property.

Personal property left by the tenants can be forwarded at postage cost plus mileage.
Unclaimed articles will be disposed of after a period of 28 days

Cancellation

In the event of a cancellation, for any reason, we will make every effort to re-let the property at full cost (or reduced rate if applicable). If the property has been re-let, we will refund all monies paid less a £50 administration fee, once the payment in full has been received by us for the new booking and these funds have cleared. 
If we are unable to re-let the property you will become liable for the full cost of the booking.
It is a condition however that we are notified immediately by telephone (Jayne 07968114227) of the circumstances giving rise to a cancellation, and promptly confirmed in writing.

We strongly recommend that you take out Cancellation Insurance.
